THE CHARGE AS THE WAY OF THE ILLEGAL INFLUENCE ON JURY

In the paper the problem of judge influence by final speech on moral certainty of jury is considered. The analysis of the theory and practice revealed the mechanism, the reasons and consequences of the influence. The special attention is given to requirements of item 3 part 3 article 340 of Criminal Procedure Code of the Russian Federation. The socially-psychological aspect of judge influence on jury and difficulties of problem solving concerned with it are mentioned. In the issue ways of the decision of the stated problem with legislative and judicial enforcement points of sight are proposed.
