Clause is devoted to problem aspects of a remedial regulation of reception by bodies of preliminary investigation of the judicial sanction to production of a search under operating criminally-remedial legislation of Russia. On the basis of the analysis of investigatory practice and separate decisions of the Constitutional Court of the Russian Federation, made offers on perfection of procedure of the precautionary judicial control over a stage of pre-judicial production.
